This Privacy Policy explains how Kaltura, Inc. (“Kaltura”) collects, uses, processes, protects, and discloses information when you use the Kaltura Platform or Kaltura Websites. By using the Kaltura Platform or Websites or services, you consent to this Privacy Policy.

What This Privacy Policy Covers

This policy describes how Kaltura treats Personal Information that it collects, receives, processes, stores, distributes, and displays via the Kaltura Platform and on the Kaltura Websites.

Personal Information” is information about you that is personally identifiable by name or can be linked to you through a personal identifier like your address, e-mail address, phone number, or location, and which is not otherwise publicly available.

In this policy, “you” means any person or organization that is authorized to use the Kaltura Platform or Website; “we” means Kaltura, including our subsidiaries and affiliates.

Partner” or “Kaltura Partner” means trusted third parties and business associates that provide us with some of the services that we provide to you. For example, our Partners include content distribution networks (CDNs), third-party platforms that are integrated with the Kaltura Platform via APIs or plug-ins, third-party services you can access through the Kaltura Platform, and marketing partners.

Customer” or “Kaltura Customer” means individuals or organizations that have permission to use the Kaltura Platform to provide services and distribute video content.

The “Kaltura Platform” means any of the cloud-based hosted services, APIs, plug-ins, apps, custom websites, and storage provided by Kaltura to its Customers.  

The “Kaltura Websites” are websites and apps belonging to Kaltura that link to this Privacy Policy.

 

When Does Kaltura Collect Personal Information?

In general, Kaltura collects Personal Information about you in the following situations:

·         When you purchase services or software from Kaltura

·         When you use the Kaltura Platform to store and provide content to members of your organization, your employees, affiliates, viewers, or any other third parties authorized by you to use the Kaltura Platform or access your media content (collectively, your “Users”)

·         When you interact with the Kaltura Platform via a Kaltura Customer

·         When you visit the Kaltura Websites

·         When you register with Kaltura through one of the Kaltura Websites or otherwise contact Kaltura

·         When you enter promotions and contests offered by Kaltura

 

Information Collected from your Activity on the Kaltura Platform

What Personal Information we collect:

When you use the Kaltura Platform as a Kaltura Customer to process and provide information and content to your Users, or interact with the Kaltura Platform as a User, or the following Personal Information may be collected and processed:

a.    Information you upload – The Kaltura Platform can be used to store media content and metadata that you upload, which may potentially include Personal Information about you, your Users, and other third parties. 

b.    Information provided by you – You may enter or create Personal Information when you use certain functions of the Kaltura Platform, like managing user lists and permissions and adding metadata to content.

c.    Traffic information, activity, and login credentials – When you interact with the Kaltura Platform, the system collects the traffic information needed to deliver your actions and requests over the internet such as IP addresses, and URLs. The Kaltura Platform uses cookies and may collect other system information such as MAC addresses to allow the system to recognize you, remember your preferences, and/or support the use of digital rights management systems. The Kaltura Platform also collects the user IDs and passwords used in order to access the Kaltura Platform.

d.    Contact and billing information – When you become a Kaltura Customer, we collect your contact and billing information.

How we use your Personal Information

Kaltura does not share your information, including Personal Information, with any third parties except our trusted Partners (as explained below).

We use your information solely for the following purposes:

a.    Providing you, as a Customer or User, with the services, functions, and actions you request from us and from our trusted Partners.

b.    Providing support, service notices, and billing to our Customers.

c.    Sending you offers and promotional information.

d.    Creating aggregate statistics and analytics information for our Customers’ use.

The production activity on the Kaltura Platform is logged within the system for the purpose of providing Kaltura Customers and Partners with statistical analysis of use, to enable system monitoring, security auditing, error tracking, and reporting of activity via the system, and to comply with data retention rules and internal policies that apply to Customer data. We use commercially reasonable methods to keep production logs secure and do not use them for any other purpose or share them with third parties (except in cases where disclosure is required by law).

Disclosures of Information under Customer Control

Please be aware that our Customers use the Kaltura Platform to store, process and distribute videos and other information belonging to them or their Users through  websites, apps, or other means. Depending on the configuration of the Kaltura Platform by the Customer and Users, videos and other information on the Kaltura Platform may be viewable to the general public or to limited audiences. We encourage Kaltura Customers to learn how to use the permission controls and content distribution features of the Kaltura Platform and exercise good care and judgment when sharing information through the Kaltura Platform. As the controller of Personal Information on the Kaltura Platform, our Customers are responsible for maintaining the privacy of Personal Information pertaining to their Users.  Kaltura is not responsible for disclosures of information made by our Customers and Users through their or your use of the Kaltura Platform.

 

Your Activity on the Kaltura Platform via Kaltura Customers

We provide the Kaltura Platform to our Customers, who use the Kaltura Platform to process and distribute content and other services to their Users.  This Privacy Policy does not apply to the collection, use, and disclosure of Personal Information by our Customers using the Kaltura Platform.  If we process your Personal Information on behalf of a Customer, it is that Customer’s responsibility to protect your privacy.

If you are concerned about your privacy while using service provided by a Kaltura Customer, you should address requests and inquiries relating to your Personal Information directly to that Customer. We may forward requests or inquiries you send to the Customer on whose behalf we are collecting or processing your Personal Information.

 

Your Activity on Kaltura Websites

What Personal Information we collect

Like most other websites, when you visit any of the Kaltura Websites Kaltura automatically receives and records information from a variety of sources, such as information from your browser, Kaltura and third-party Cookie information, web beacons, VAST tags, pixel tags, social media buttons, URL links, and other methods.

When you register with Kaltura we ask for information such as your name, email address, birth date, gender, ZIP code, website, and personal interests. When you register with Kaltura and sign in to the Kaltura Website, you are not anonymous to us.

How we use your Personal Information

We use your information solely for the following general purposes:

a.    Performing your actions and providing you with the services you request via the Kaltura Platform.

b.    Contacting you and sending you promotional e-mails.

c.    Remembering information you entered on our Websites.

d.    Improving our Websites, services and products.

e.    Customizing the advertising and content you see.

f.     Conducting research and providing anonymous statistical reporting for internal and external clients.

Although most information collected automatically is not personally identifiable, we or our Partners may aggregate or combine this information with other information making it identifiable as Personal Information.

Children

We do not permit children under the age of 13 to register with Kaltura.

If we become aware that we have inadvertently received Personal Information from a child under the age of 13, or information pertaining to such a child, we will delete such information from our records.

 

Sharing information with trusted business Partners and marketing

We may share Personal Information with our Partners who work on our behalf under confidentiality agreements. These Partners may use your Personal Information to help Kaltura communicate with you about offers from Kaltura and our marketing Partners. However, these Partners do not have any independent right to share your information with other parties or use it for other purposes.

Kaltura may display targeted advertisements based on Personal Information. Ad serving companies may make inferences based on this information in order to provide targeted ads to people who meet the targeting criteria—for example, advertisers may presents certain ads only to women aged 18-24 from a particular geographic area.

Kaltura does not provide any Personal Information directly to the advertiser of a targeted ad when you visit our Websites. However, ad networks that provide targeted advertisements may collect and aggregate information about you and use that information to serve targeted ads to you.  

Kaltura and its affiliates are located in different regions around the world, and Kaltura works with Partners across different industries, categories of business, and in many different regions. By accessing the Kaltura Websites, you consent to the transfer of your information outside of your local jurisdiction. Cookies and other activity tracking technologies

When you visit Kaltura Websites, we may set and access Kaltura cookies on your computer and access web beacons, VAST tags, and other technologies that tell us how you interact with our Websites, e-mails, and media players.

Kaltura allows other companies that show advertisements on the Websites to set and access their cookies on your computer. Other companies' cookies may be subject to their own privacy policies.

Most Internet browsers have options for controlling, disabling, and deleting cookies on your computer. In addition, many ad networks have joined the Digital Advertising Alliance’s self-regulatory program to provide a single opt-out tool at: http://www.aboutads.info and at the European Interactive Digital Advertising Alliance (EDAA) website: http://youronlinechoices.eu. However, Kaltura does not guarantee that using these tools will prevent online behavioral tracking using cookies through our website.

At present, Kaltura and our third-party Partners do not honor Do Not Track signals set by some browsers. If you wish to avoid behavioral tracking by ad networks, please choose from the available methods for doing so or refrain from using the Kaltura Websites.

 

Editing and Deleting Your Account Information and Preferences

If you have an account with Kaltura, you can review, correct, edit, or delete the Kaltura account information that you provided to us at any time by logging in to your account online. You may also send us an e-mail request at support@kaltura.com. Please note that we may need to verify your identity before acting on your request. You may elect to “opt out” of receiving direct marketing or being included in market research information. This means we assume you consent to us collecting and using your information in accordance with this Privacy Policy unless you take affirmative action to opt out of collection. You may opt out at any time by sending an e-mail request to support@kaltura.com (please indicate “Opt Out” in the subject line). 

Please note that new categories of communication and notification might be added to the Preferences page from time to time. You can opt out of receiving future communications from these new categories or you can unsubscribe and block future messages by following instructions through the unsubscribe option in those messages.  If you are a Kaltura Customer you will continue to receive certain communications pertaining to your Kaltura Customer account such as service announcements and administrative messages even if you opt out of marketing communications from Kaltura.

You can suspend your Kaltura account on the Kaltura Websites at any time by following the instructions on the relevant section of the Kaltura Websites.

While we will try to comply with any request pertaining to your Personal Information in accordance with applicable law, but please be aware that we may not be able to fulfill requests pertaining to information already shared with third parties. Some information may be retained on our systems for recordkeeping purposes, and some residual digital information cannot be removed or changed.

 

Disclosure of Personal Information

We do not sell, disclose, or share Personal Information about you with third parties except under the following circumstances:

•      To provide products and services, or to perform actions you request.

•      When we have your permission.

•      When required by law to respond to subpoenas, court orders, or legal process.

•      When we need to establish or exercise our legal rights, or to defend against legal claims, or when we believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Kaltura's Terms of Use, or as otherwise required by law.

•      We may transfer information about you if Kaltura is acquired by or merged with another company. In such an event, Kaltura will make a public announcement before information about you becomes subject to a different privacy policy.

•      With our trusted business Partners and marketers, as described above.

 

Retention of Information

We may retain your information (including Personal Information) for any lawfully permitted period of time, and as required by applicable laws and statutes.

 

Confidentiality and Security

We take great precautions to protect Personal Information about you. However, no data transmission over the Internet or any other network can be guaranteed to be 100% secure. While we strive to protect information transmitted on or through our Website or the Kaltura Platform, we cannot and do not guarantee the security of any information you transmit.

European Union and Swiss Residents

For European Union and Swiss Residents, by choosing to provide us with your Personal Information, you consent to the storage and processing of that information on our servers located in the United States.

Kaltura certifies compliance with the US-EU Safe Harbor and US-Swiss Safe Harbor Privacy Principles of Notice, Choice, Onward Transfer, Security, Data Integrity, Access and Enforcement, and is registered with the U.S. Department of Commerce's Safe Harbor Program (http://www.export.gov/safeharbor).

If you use the Kaltura Platform to process Personal Information pertaining to data subjects in the European Economic Area (EEA) or are located there yourself, you are designated as the data controller, and we are designated as a data processor, unless we have agreed with you otherwise in writing.

Any questions or concerns regarding the use or disclosure of your information should be directed to Kaltura by e-mailing us at legal@kaltura.com. We will investigate and attempt to resolve complaints and disputes regarding use and disclosure of your information in accordance with this Privacy Policy. For European Union and Swiss Residents, unresolved complaints shall be submitted to binding arbitration in front of the American Arbitration Association (“AAA”). Information about AAA services can be found at its website: www.adr.org. The exclusive location for such arbitration shall be New York, NY, United States.
